HCBS Settings Rule The largest change to HCBS in recent years is the HCBS Settings Rule. According to CMS, the HCBS Settings Rule is meant to ensure HCBS services in residential and non-residential settings provide full access to the benefits of community living and offers services in the most integrated settings. HCBS services will be required to determine if provider-owned/controlled HCBS that are located in, on the grounds of, or immediately adjacent to nursing facilities, institutions for mental disease, intermediate care facilities for individuals with intellectual disabilities and hospitals fit the criteria in the final rule to be eligible to receive Medicaid waiver funding. In Iowa and nationally, the implementation of the program has been delayed since the rules introduction in 2014. Currently, Iowa extended full compliance of the HCBS Settings Rule from March 17, 2019 to March 17, 2022.
